42. Soil erosion
(1) A highway authority may, by notice in writing to the owner or occupier of a land adjoining a road for which it is responsible, require him, within
21 days from the date of service of the notice, to execute such works as will
prevent soil or refuse from that land from falling, or being washed or carried,
on to the road or into any road drain in such quantities as to obstruct the
road or choke the road drain.
(2) Any person who fails to comply, within the specified period, with a
notice served under this section shall commit an offence in respect of each
day during which the non-compliance subsists.
