72. Consent to certain statements
(1) A prospectus shall not include any statement made by a person, or
any statement said in the prospectus to be based on a statement made by a
person, unless—
(a) the person has consented to the statement being included in the
prospectus in the form and context in which it appears or referred to in the prospectus;
(b) the prospectus states that the person has given his consent;
(c) the consent is filed with the Commission; and
(d) the person has not withdrawn his consent before the date
the prospectus is lodged for provisional registration with the
Commission.
(2) For the purposes of this section, reference to “a statement by a person” shall include reference to any report, analysis or study made by such
person or referred to in such statement.
