3. Permission to build
(1) The Company may, subject to such conditions as the Minister may
impose, build an underpass underneath Port Louis Through Road for the purpose of connecting the esplanade on the waterfront with Sir William Newton
Street in Port Louis.
(2) The Company shall, at all times and at its own cost, maintain the
underpass in good repair and ensure that it is not a source of danger to the
public.
