23. Application to State of certain statutes
This Act shall not prejudice the right of the State to take advantage of an
enactment although it is not named in the enactment and, in civil proceedings against the State, an enactment which could, if the proceedings were
between subjects, be relied on by the defendant as a defence to the proceedings may, subject to any express provision to the contrary, be so relied
on by the State.
