38. Carrying on or running tourist enterprise after suspension or closing order (1) Any person who carries on or runs a tourist enterprise under a suspended licence, or in breach of a closing order, shall commit an offence and, shall, on conviction, be liable to a fine of not less than 10,000 rupees and not exceeding 100,000 rupees and to imprisonment for a term not exceeding 2 years. (2) In the case of a second or subsequent conviction, the offender under subsection (1) shall be liable to a fine of not less than 20,000 rupees and not exceeding 200,000 rupees and to imprisonment for a term not exceeding 5 years.
