63. Public interest and lesser duty rule (1) The Investigating Authority shall examine whether the imposition of anti-dumping duty or countervailing duty shall be in the interest of Mauritius, due regard being given to the interest of the domestic industry, the situation of domestic competition for the product under investigation, the needs of industrial users and the interest of consumers. (2) The Investigating Authority shall examine whether a duty less than the full dumping margin shall be adequate to remove the injury to the domestic industry. (3) Where the Investigating Authority determines that a lesser duty shall be adequate to remove the injury, the amount of the final anti-dumping duty or countervailing duty imposed shall not exceed that lesser duty.
