4. Scope of Act
(1) This Act shall apply to—
(a) all waqfs created by members of the Sunni Muslim community;
and
(b) subject to subsection (1A), all waqfs created by members of the
Shia Muslim community.
(1A) Where, in any matter, the law governing waqfs created by members
of the Shia Muslim community in any way differs from the corresponding
provisions of law governing waqfs created by members of the Sunni Muslim
community, as set out in this Act, that matter shall be decided by the Court
in accordance with the Shia Muslim law of waqf.
(2) All questions relating to waqfs dedicated by members of the Sunni or
Shia Muslim communities shall be within the jurisdiction of the Court and,
subject to subsection (1A), shall be decided in accordance with this Act.
