38A. Notification of occupational disease
(1) An employer shall, within 3 days of the receipt of a certificate duly
signed by a certifying surgeon to the effect that a workman employed by
him suffers from a disease—
(a) specified in the Second Schedule; or
(b) which, in the opinion of the certifying surgeon who issued the
certificate, is due to the nature of the employment of the
workman,
forward, to the Permanent Secretary of the Ministry, a copy of the medical
certificate together with a statement showing the nature of the work on
which the workman was employed for the period of 12 months before the
date on which the certificate was issued by the certifying surgeon.

(2) Any employer who fails to comply with this section shall, on conviction, be liable to a fine not exceeding 500 rupees.
