23. Occupier to recover expenses from owner
(1) Subject to subsection (3), where an occupier who is not liable for the
costs of any repairs has, following a notice served under section 22, complied with the order in default of the owner, he shall, where he has given
previous notice to the owner, recover from the owner the cost of the repairs
and collateral expenses.
(2) A notice under section 22 shall constitute evidence before any Court
that the building was in a dangerous state and that repairs were required.
(3) The cost and collateral expenses of the repairs to the dangerous
building shall be claimed from the owner and may be recovered from the rent
payable.
