Section 56: Penalties and directions

56. Penalties and directions (1) The Commission shall not impose a penalty on, or give a direction to, an enterprise, under Part VI, unless it has held a hearing in relation to that enterprise. (2) Notwithstanding subsection (1), the Commission may impose a penalty or make a direction if the enterprise concerned has elected not to attend a hearing requested by the Commission or has failed to attend a hearing when required to do so by the Commission.
