26. Averment as to intent to defraud (1) In an information for forging, uttering, offering, disposing of, or putting off an instrument, or for obtaining a property by false pretences, it shall be sufficient to allege that the accused did the act with intent to defraud, without alleging the intent of the accused to defraud a particular person. C59 – 9 [Issue 1] Criminal Procedure Act (2) On the trial of an offence specified in subsection (1), it shall not be necessary to prove an intent on the part of the accused to defraud a particular person, but it shall be sufficient to prove that the accused did the act charged with an intent to defraud.
