38. Effect of acquittal on party charged
The acquittal of a party charged as accessory before the fact to a crime,
shall be no bar to a charge against him as principal, and the acquittal of a
party charged as a principal in crime, shall be no bar to a criminal information
charging him as an accessory before the fact.
