39. Effect of conviction on party charged The conviction of a party charged as an accessory before the fact to a crime, shall be a bar to a charge against him as a principal offender in respect of the same offence, and the conviction of a party charged as a principal shall be a bar to a criminal information charging him as an accessory before the fact to the same offence.
