79. Demurrer against or for accused
(1) Where a demurrer is found against the accused, the judgment—
(a) in the case of crime, shall not be final, but the accused may
plead over not guilty;
(b) in the case of misdemeanour, shall be final, and may be given
against the accused as if he had been convicted.
(2) Where a demurrer is found for the accused, the judgment shall be the
dismissal and discharge of the accused.
