38. Incitement to drug offences and unlawful use
Any person who unlawfully—
(a) by any means whatsoever, directly or indirectly incites others to
commit any of the offences specified in this Act, even when
such incitement is without effect;
(b) by any means whatsoever, directly or indirectly incites others to
make unlawful use of dangerous drugs or of substances presented as having the effects of such drugs,
shall commit an offence and shall, on conviction, be liable to a fine not exceeding 500,000 rupees and to imprisonment for a term not exceeding
15 years.
