Section 44: Order for check-off agreements

44. Order for check-off agreements (1) Where an employer refuses to enter into a check-off agreement under section 43, a trade union of workers may make an application to the Tribunal for an order that a check-off agreement shall have effect between the trade union and the employer and, on hearing the application, the Tribunal may make such order as it deems fit. (2) Any application made under subsection (1) shall be determined by the Tribunal within 30 days of the date of receipt of the application. (3) An employer shall comply with an order made under subsection (1) within 2 months of the date of the order.
