46. Agency shop agreements
(1) Where a check-off agreement and a collective agreement are in force,
a recognised trade union of workers or a joint negotiating panel may enter
into an agreement with an employer for a deduction of an agency fee from
the wages of workers in a bargaining unit who are not members of the trade
union.
(2) A deduction under subsection (1) shall only be made if the worker
consents thereto in writing.
