87. Prosecution and jurisdiction (1) An authorised officer may swear an information and conduct prosecution in respect of an offence under an environmental law before a Magistrate. (2) Notwithstanding— (a) section 114 of the Courts Act; and (b) section 72 of the District and Intermediate Courts (Criminal Jurisdiction) Act, E12 – 51 [Issue 2] Environment Protection Act a Magistrate shall have jurisdiction to try all offences under an environmental law and may impose any penalty and exercise all the ancillary powers provided under the enactment. (3) The following enactments shall not apply to a sentence provided under an environmental law— (a) sections 152 and 153 of the Criminal Procedure Act; (b) the Probation of Offenders Act.
