55. Warrant to enter and search
(1) A Magistrate shall, where he is satisfied by information upon oath
that there is reasonable ground to believe that an offence against this Act
has been, is being or is about to be committed, issue a warrant authorising a
fishery control officer to enter and search any boat, vessel, premises or
dwelling house.
(2) Where the Permanent Secretary is satisfied by information upon oath
that—
(a) there is reasonable ground to believe that an offence against this
Act has been, is being or is about to be committed; and
(b) communication with a Magistrate for the purpose of securing a
search warrant may cause delay,
he may issue a search warrant authorising a fishery control officer to enter
and search any boat, vessel, or premises, except a dwelling house.
