256. Vacancy of office, resignation or removal (1) The office of a deed administrator shall be vacant if the deed administrator— (a) resigns; (b) becomes disqualified; or (c) is removed by the Court. [Issue 3] I14 – 146 Revised Laws of Mauritius (2) A deed administrator may resign by giving written notice to the company. (3) The Court may— (a) remove a deed administrator and appoint a person in his place; or (b) appoint a new deed administrator, if the deed of company arrangement has not yet terminated but for some reason no deed administrator is acting. (4) The Court may make an order under subsection (3) on the application of a creditor of the company, a shareholder, the liquidator (if the company is in liquidation), the Registrar of Companies or the Director.
