396. False proof by creditor
Any person who—
(a) makes, or authorises the making of, a proof under section
305 (3) that is false or misleading in a material particular, knowing that it is false or misleading; or
(b) omits, or authorises the omission any matter, from a proof under section 305 (3), knowing that the omission makes the proof
false or misleading,
shall commit an offence and shall, on conviction, be liable to imprisonment
for a term not exceeding 5 years and to a fine not exceeding 1,000,000 rupees.
