95. Default by debtor (1) A debtor who defaults in paying any sum due under a summary instalment order shall be presumed, unless the contrary is proved, to have— (a) been able to pay the sum from the date of the order; and (b) refused or neglected to pay it. (2) Where a debtor defaults in making payment in accordance with the order, unless the Court otherwise orders— (a) proceedings that have been stayed under section 91 may begin or continue; and (b) any period during which proceedings were so stayed must be added to any period of limitation that applies to the proceedings.
