37. Fit and proper person
(1) The Commission shall be deemed to have approved the appointment of
a person under section 36 where it has not objected to such appointment
within 15 days after having been notified in writing of the proposed
appointment.
(2) Where the Commission considers that a person referred to in section 36 is not fit and proper, it shall give to the insurer and to the person
concerned a notice of its intention to object to such appointment, and the
appointment shall be of no effect for so long as the notice of objection is not
withdrawn.
(3) The Commission shall not confirm its objection made under subsection (2) without giving the insurer and the person concerned an opportunity
to make representations on the objection.
(4) The Commission may, after taking into consideration the representations made under subsection (3), withdraw a notice of objection given under
subsection (2).
