76. Responsibilities of Permanent Secretary
(1) Subject to subsections (2) and (3), the Permanent Secretary shall, for
the purposes of the Local Government Service Commission Act, be the responsible officer of every Chief Executive.
(2) The Permanent Secretary shall report to the Local Government Service Commission any Chief Executive who has—
(a) failed to exercise administrative or financial control in accordance with his responsibilities;
(b) failed to execute the policies, projects or decisions and directives
of the Council, provided they are not inconsistent with existing
legislation and established procedures; or
(c) committed an act of gross misconduct, misbehaviour or insubordination.
(3) Where, following a report made under subsection (2), the Local Government Service Commission is of the opinion that disciplinary action should
be taken against the Chief Executive, the Permanent Secretary shall, after
consulting the Solicitor-General, draw up the appropriate charge.
