Section 108: Application of Safety Convention

108. Application of Safety Convention (1) Subject to subsection (2), the Safety Convention shall, unless she is exempted by section 109, apply to a Mauritius ship engaged on an international voyage and to a foreign ship engaged on such a voyage while she is in Mauritius waters. (2) The Safety Convention shall not apply to— (a) warship and troop ships; (b) cargo ships of less than 500 tons; (c) ships not propelled by mechanical means; (d) wooden ships of primitive build; (e) pleasure vessels not engaged in trade; and (f) fishing vessels. (3) Notwithstanding subsection (1), this section and sections 110 and 111 shall not apply to a foreign ship that would not be within a Port but for such stress of weather or any other circumstances that neither the master, owner nor charterer, if any, of the ship could have prevented or forestalled.
