146. Salvage contracts (1) Subject to subsection (3), this Sub-Part shall not apply to any salvage operation where a contract expressly or by implication provides otherwise. (2) The master of a Mauritius vessel shall have the authority to conclude contracts for salvage operations on behalf of the owner of the vessel, and the master and the owner of a Mauritius vessel shall have the authority to conclude contracts on behalf of the owner of property on board the vessel. (3) Any contract relating to salvage may be annulled or modified by the Supreme Court, where it appears to the Court that— (a) the contract has been entered into under undue influence or the influence of danger and its terms are inequitable; or (b) the payment under the contract is too large or too small for the services actually rendered.
