Section 46: Regulations

46. Regulations (1) The Minister may, after consultation with the Board— (a) make such regulations as he considers necessary for the purposes of this Act; (b) by regulations, amend the Schedules; and (c) by regulations, amend this Act for the purpose of giving effect to any agreement with the Government of any country outside Mauritius providing for reciprocity in matters relating to payments provided under this Act in order to— (i) secure that acts, omissions and events having any effect for the purpose of the law relating to social security in the country in respect of which the agreement is made shall have a corresponding effect for the purposes of this Act; (ii) determine in cases where rights accrue both under this Act and the law of that country, the rights which shall be available to the person concerned; and (iii) make any necessary financial adjustments. (2) Regulations made under subsection (1) may provide that any person who contravenes those regulations shall commit an offence and shall, on conviction, be liable to a fine not exceeding 50,000 rupees and to imprisonment for a term not exceeding 12 months.
