8. Inquiries (1) Subject to subsection (2), the Prime Minister may, in respect of any matter connected with the Open University, institute an inquiry to be made by such person as he may appoint, in such manner as he may determine. O6A – 5 [Issue 4] Open University of Mauritius Act (2) Where the Prime Minister decides to institute an inquiry under subsection (1), he shall, in every case, give notice to the Chairperson of the Board of his intention to do so and the Board shall be entitled to be represented at such inquiry. (3) The Prime Minister— (a) shall communicate to the Board his views with reference to the result of any such inquiry; and (b) may, after ascertaining the opinion of the Board, advise the Open University regarding the action to be taken and fix a timelimit for taking such action. (4) The Board shall, within the time-limit so fixed, report to the Prime Minister the action taken or proposed to be taken on any advice tendered under subsection (3) (b). (5) Where the Board does not take action within the time fixed or the action taken by the Board is, in the opinion of the Prime Minister, not satisfactory, the Prime Minister may, after considering any explanation or representation made by the Board, issue such directions as he thinks fit and the Board shall comply with any such directions.
