164. Conditions of permit to exhume
(1) The permitting authority may specify such precautions as he thinks fit
as a condition of the grant of the permit.
(2) Any person who—
(a) exhumes a dead body or any human remains in contravention of
this Act; or
(b) neglects to observe the precautions specified in the permit,
shall commit an offence and shall, on conviction, be liable to a fine not exceeding 1,000 rupees.
(3) Notwithstanding subsection (2), a Magistrate may order the exhumation of a dead body or human remains for the purpose of holding an inquiry
into the cause of death of any person.
