10. Concession presumed not for irrigation
Any concession of water from a river or stream, of which the titles of
concession have been lost, shall be presumed, until the contrary is proved,
to be—
(a) for purposes other than irrigation; and

(b) subject to the condition of returning the water to the river or
stream, so far as not required for the purpose of the concession.
