97. Assessment of compensation
(1) The compensation allowed by section 95 shall be assessed where the
amount claimed does not exceed 1,000 rupees, by the Magistrate of any of
the districts in which the claim for compensation has arisen, and where the
amount claimed exceeds 1,000 rupees, by 2 arbitrators selected one by the
Governor-General and the other by the party to be compensated, and
where the arbitrators disagree, by an umpire appointed by the Supreme
Court on motion.
(2) An umpire appointed under subsection (1) shall not award less than
the lower sum nor more than the higher sum assessed by the arbitrators.
