22A. Jurisdiction of Court
(1) Notwithstanding section 114 of the Courts Act, a Magistrate shall
have jurisdiction to try all charges relating to offences under sections 21 and
22 and may impose all fines provided for under those sections.
(2) (a) In any proceedings for an offence under section 22, the Court
may, where the person charged proves to its satisfaction that his default
was not due to carelessness or an intention to defraud the revenue, mitigate
the penalty prescribed for the offence.
(b) No mitigated penalty imposed by the Court under this subsection
shall, in any case, be less than 25 rupees.
