169. Application for certificate
(1) Immediately after the date of the transcription of the title of an adjudicatee, the party having the carriage of the proceedings or notwithstanding
article 2201 of the Code Civil Mauricien, a notary designated by the Master
shall apply, in writing, to the Conservator of Mortgages for a certificate of
any inscription burdening the property sold.
(2) Where an application under subsection (1) is not made within 15 days
after the transcription, the most diligent among the creditors or the purchaser may make the application and, on doing so, shall be ipso facto subrogated in the carriage of the proceedings.
