151. Power to grant relief (1) Where, in civil proceedings against a person for negligence, default, breach of trust or breach of duty in a capacity as such a person, it appears to the Court that the person is or may be liable in respect of the negligence, default or breach but that the person has acted honestly and that, having regard to all the circumstances, the person ought fairly to be excused, the Court may make an order relieving the person, wholly or partly, from liability on such terms as the Court thinks fit. [Issue 1] S7 – 56 Revised Laws of Mauritius (3) Any application under this section shall be made in the presence of the Commission.
