100. Involuntary homicide and wounds and blows
(1) Where a person is convicted of an offence under section 239 of the
Criminal Code in connection with the operation of a pleasure craft or an
exempt pleasure craft, the offence of which he is convicted shall, for the
purposes of section 105, be deemed to be an offence under this Act.
(2) Where, on the trial of a person for an offence under subsection (1)—
(a) it has not been established to the satisfaction of the Court that
the manner in which the person operated the pleasure craft or
exempt pleasure craft, was the cause of the death or of the
wounds and blows, as the case may be; but
(b) it has been established to the satisfaction of the Court that he
has committed an offence under section 92 or 93,
the Court may convict him of that offence.
