90. Prohibition
(1) Where having regard to the—
(a) prevailing climatic conditions;
(b) seaworthiness of a pleasure craft;
(c) number and state of safety equipment on board of a pleasure
craft,
an authorised officer is of the opinion that the journey which the pleasure
craft is undertaking or about to undertake, is unsafe, the officer shall direct
the owner, skipper or any other person in charge of the pleasure craft in a
navigational area to return ashore or not to proceed with the journey, as the
case may be.
(2) Any person who fails to comply with a direction given under subsection (1) shall commit an offence and, shall, on conviction, be liable to a fine
of not less than 1,000 rupees and not exceeding 10,000 rupees and to
imprisonment for a term not exceeding 6 months.
