38. Notice of injurious effluent
(1) Where the Authority has reason to believe that effluent from any premises is being put, or allowed to be put, in the waste water system in contravention of section 37, the Authority may serve a notice on the owner, occupier,
manager or other person in charge of the premises, requiring him to take appropriate steps to prevent injury or prejudice likely to be caused to the waste
water system within such reasonable time as may be specified in the notice.
(2) Every person on whom a notice is served under subsection (1) shall
comply with it within the time specified in the said notice.
(3) A notice under subsection (1) may specify the nature of the remedial
or preventive measures to be taken.
(4) Where a person on whom notice is served under subsection (1) fails
to comply with the notice, the Authority may, after it has given to that person not less than 24 hours’ notice, enter the premises, and take whatever
steps it considers necessary to prevent the injury or prejudice likely to be
caused, and claim from the owner or occupier the costs of its intervention.
(5) The service of a notice under this section does not preclude a prosecution for an offence.
