39. Notice of contravention
(1) Where the Authority has reason to believe that this Act is likely to be
contravened or is being contravened, the Authority may serve a notice on
the owner or occupier of premises requiring him to ensure, within such time
as may be specified in the notice, that the contravention does not occur or
continue, as the case may be.
(2) A notice served pursuant to subsection (1) shall—
(a) indicate the provision that is likely to be or is being contravened;
and
(b) shall not preclude a prosecution for an offence.
