40. Waste water works
(1) Where the Authority is of the opinion that waste water works have to
be carried out on any premises to prevent risk of danger to the occupants of
those premises or to the public, the Authority may serve a notice requiring
the owner or occupier of the premises to carry out such waste water works
as may be necessary in the circumstances, within the time limit fixed in the
notice.
(2) Where a person, on whom a notice under subsection (1) has been
served, fails to comply with that notice, the Authority may, after it has given
to that person not less than 24 hours’ notice, enter the premises and carry
out the waste water works.
(3) The costs of the works carried out under subsection (2) shall be
borne by the person on whom notice was served.
