44. Restricted use of land where sewers exist
(1) No person shall, without the approval of the Authority—
(a) raise any structure or building on any land where sewers have
been laid; or
(b) carry out, on the land, any other works in a way likely to interfere with the sewers or to prevent access to them.
(2) Where an application for an approval under subsection (1) is made,
the Authority may carry out such enquiries and investigations as the Authority thinks fit.
(3) The Authority shall consider the application, and may refuse or grant
the approval, subject to such terms and conditions as it thinks fit to impose.
(4) A person aggrieved by the Authority’s refusal to approve an application made under subsection (2), or with the terms and conditions attached to
an approval, may, within 21 days of the Authority’s decision being communicated to him, appeal in writing to the Minister.
