Section 389: False or misleading statement

389. False or misleading statement Any person who— (a) for the purposes of or in connection with any application under this Act; (b) in purported compliance with any requirement imposed by or under this Act; or (c) in relation to any report to the Court or to a liquidator, receiver or administrator or the Insolvency Service or the Official Receiver, furnishes information knowing it to be false or misleading in a material respect, or recklessly furnishes information which is false or misleading in a material respect or intentionally omits to disclose any matter or thing without which any application, report or information is misleading in a material respect, shall commit an offence and shall, on conviction, be liable, to a fine not exceeding 2,000,000 rupees and to imprisonment for a term not exceeding 2 years.
