Section 123AD: Drivers to comply with traffic directions and signs

123AD. Drivers to comply with traffic directions and signs (1) Any person driving a vehicle who neglects or refuses to— (a) stop the vehicle; or (b) make it proceed in, or keep to, a particular line of traffic, when directed to do so by the police officer in the execution of his duty, shall commit an offence. (2) Where a traffic sign, being a sign of the prescribed size, colour and type authorised under section 184 or 185 has been placed on or near a road, a person driving a vehicle who fails to comply with the indication given by the sign shall commit an offence. [Issue 7] a vehicle who neglects or refuses to— (a) stop the vehicle; or (b) make it proceed in, or keep to, a particular line of traffic, when directed to do so by the police officer in the execution of his duty, shall commit an offence. (2) Where a traffic sign, being a sign of the prescribed size, colour and type authorised under section 184 or 185 has been placed on or near a road, a person driving a vehicle who fails to comply with the indication given by the sign shall commit an offence. [Issue 7] R27 – 108 Revised Laws of Mauritius (3) Where— (a) a traffic survey of any description is being carried out on, or in the vicinity of a road; and (b) a police officer gives to a person driving a vehicle a direction to— (i) stop the vehicle; (ii) make it proceed in, or keep to, a particular line of traffic; or (iii) proceed to a particular point on, or near the road on which the vehicle is being driven, being a direction given for the purpose of the survey, the person shall commit an offence if he neglects or refuses to comply with the direction. (4) Any direction given by a police officer shall override a traffic sign. (5) Any traffic sign placed on or near a road shall be presumed to have been lawfully placed.
