Section 35B: Medical assistance

35B. Medical assistance (1) (a) Every employer shall furnish such appliances and maintain such services, for the rendering of first aid to his workmen in case of accident, as may be prescribed in respect of the class of business, trade or calling in which he is engaged. (b) Any employer who contravenes this section shall commit an offence and shall, on conviction, be liable to a fine not exceeding 100 rupees. (2) (a) Where a workman has suffered an injury necessitating his removal to his residence or to a hospital, the employer shall provide at his own expense the necessary means of conveyance for the removal of the workman. [Issue 1] W9 – 20 Revised Laws of Mauritius (b) Any employer who fails to comply with this section shall commit an offence and shall, on conviction, be liable to a fine not exceeding 100 rupees and shall, in addition be liable to pay to the workman the reasonable expenses incurred on the occasion of the removal, as determined by the Court.
